GENERAL CONTRACTUAL CONDITIONS

These Terms govern the use of the site elitextraining.eu (the “Site”) and the purchase of products offered by ELITEX ECOMMERCE, S.L. (“Elitex Training”, “we”).
By placing an order, the customer declares that they have read and accepted these Terms and Conditions. The version in force at the time each order is placed will apply.

2. Scope of application
These Terms and Conditions apply to all orders placed through elitextraining.eu, without prejudice to the specific conditions applicable to certain products, promotions or professional channels.
The provisions relating to consumers apply exclusively to natural persons acting for purposes unrelated to their trade, business, craft or profession.
Transactions carried out by companies or professionals may be subject to specific B2B conditions.
3. Capacity and user account
To make a purchase, the customer must have sufficient legal capacity to enter into a contract. Minors may only purchase with the intervention or authorization of their legal representatives.
Purchases can be made as a guest or through a user account. Users must provide truthful, complete, and up-to-date information, protect the confidentiality of their credentials, and immediately report any unauthorized access.
4. Product and price information
Product features, descriptions, photographs, and availability are shown on each product page. Images are for illustrative purposes only, and minor differences in color or finish may exist due to screen display, lighting, or manufacturing improvements.
Prices are subject to change at any time, but changes will not affect orders already placed. The total price, applicable taxes, and shipping costs will be displayed before you confirm your purchase.
Prices include applicable VAT where appropriate, except for B2B intra-community transactions that qualify for exemption or shipments subject to different tax or customs rules.
When a backpack or bag is described as "cabin baggage compliant," this refers solely to its dimensions. It does not guarantee free transport or acceptance by all airlines, as this depends on the airline, fare purchased, and airport security procedures.
5. Taxes, tariffs and customs management
For shipments to mainland Spain, the Balearic Islands and destinations in the European Union subject to the ordinary regime, the corresponding VAT will be applied in accordance with current regulations, including, where applicable, the OSS single window regime.
For shipments to the Canary Islands, Ceuta, Melilla, Andorra and other territories located outside the territory where VAT applies in the European Union, as well as to third countries, local taxes, import VAT or GST, duties, fees and clearance costs may be required.
Unless expressly stated during the purchase that they are included, these amounts will be borne by the recipient.
International shipments are generally made under the DAP (Delivered At Place) condition, in accordance with Incoterms® 2020.Elitex Training arranges transport to the agreed destination and the recipient assumes, where applicable, the import clearance and the taxes and charges required at the destination.
The buyer must provide the documents or tax identifiers required by the authorities or the carrier, such as NIF, EORI, CPF, RFC or other equivalents.
Customs inspections and procedures may cause delays beyond Elitex Training's control. These delays will not, in themselves, give rise to compensation, without prejudice to the consumer's legal rights in the event of non-delivery or excessive delay.
If the recipient unjustifiably refuses the shipment, does not pay the import fees, or does not provide the information necessary for clearance, the package may be returned, abandoned, or destroyed by decision of the authorities or the carrier.
When the goods are recovered, the refund may be reduced by the actual and justified costs of shipping, return and handling, respecting the inalienable rights of the consumer.
Elitex Training declares products with their actual market value, tariff code, and country of origin. Values will not be artificially reduced, nor will orders be declared as gifts.
5.1. Invoicing to companies and intra-community VAT
Customers acting as entrepreneurs or professionals established in another Member State of the European Union may enter a valid intra-community VAT number in the field provided during the payment process.
Once the number is validated and the transaction meets the applicable legal requirements, including the transport of the goods to a Member State other than the country from which they are dispatched, the order will be processed without VAT charges.
The buyer will be responsible for declaring the acquisition and settling the tax in their country through the corresponding mechanism.
The exemption will not apply to:

Companies or professionals established in Spain when the goods are delivered from Spain.

Private clients.

Invalid VAT numbers, unregistered or not validable in VIES.

Orders whose destination matches the country from which the merchandise is prepared and shipped.
The intra-community VAT number must be provided before finalizing the order. If it is not entered at that time, the order will be processed with the applicable VAT.
Elitex Training does not guarantee the subsequent modification or refund of VAT. This will only be done when legally permissible and the client provides the necessary documentation to prove they met the requirements at the time of the transaction.
If the order has not yet been prepared or shipped, Elitex Training may, when operationally possible, cancel it so that the customer places a new one by correctly entering their VAT number.
For professional orders exceeding 2.500 € The Elitex Training B2B portal is also available. Additionally, professional orders can be placed through Faire. https://elitextraining.faire.com, in accordance with the terms and conditions of said platform.
6. Purchase and Formalization Process
To place an order, the customer must:

Check your cart.

Enter your billing and shipping information.

Select your payment method.

Review the total price and confirm the purchase.
After confirmation you will receive an email with the order details.
The contract will be considered formalized when Elitex Training confirms acceptance of the order, without prejudice to the verification of payment, availability and reasonable security controls.
Elitex Training may reject or cancel an order due to lack of stock, obvious error in the price or description, impossibility of delivery, well-founded suspicion of fraud, breach of these Conditions or insufficient or incorrect data.
In that case, the amounts paid for the products not supplied will be refunded without delay.
7. Payment methods
The available payment methods will be displayed during the purchase process.
Payment is processed through secure providers. Elitex Training does not store full card details.
The customer guarantees that they are authorized to use the selected payment method. If the payment is rejected, revoked, or not completed, the order will not be processed or may be canceled.
8. Shipping and Delivery
Destinations, carriers, costs, and estimated delivery times will be displayed during the purchase process.
Delivery times may be affected by holidays, high demand campaigns, logistical incidents, force majeure or customs controls.
Unless otherwise agreed, orders placed by consumers will be delivered within the maximum legal timeframe. If this is not possible, we will inform the customer and their rights under applicable law will apply.
The customer must provide a correct and accessible address and cooperate reasonably with the carrier.
If you fail to collect the shipment, refuse it without justified cause, or request a second shipment for a reason attributable to you, the actual and justified costs incurred may be charged.
The risk of loss or damage will be transferred to the consumer when he or a third party designated by him, other than the carrier, acquires physical possession of the products.
9. EU consumer right of withdrawal
The consumer has 14 calendar days from receipt of the order to withdraw from the contract without needing to state the reason.
For orders delivered separately, the period will begin on the date of receipt of the last product.
Electronic withdrawal function
The consumer will be able to exercise their right electronically through the function “Withdraw from the contract here”, Available at:

To submit the request, you must identify the order and the affected products. The reason for withdrawal is optional, and the consumer is not required to provide a justification.
Once the data has been completed, you must ratify your decision using the function “Confirm withdrawal”.
After confirmation, the consumer will receive without undue delay an email acknowledgment that will include:

Order identification.

The affected products.
-
The content of the application.

The date and time of presentation.
The acknowledgment of receipt confirms receipt of the request, without prejudice to the subsequent verification that the order and products are within the scope and legal period of withdrawal.
The portal will be available to both registered customers and guests who placed their orders. Creating an account or downloading an app will not be necessary.
Other ways to exercise the right of withdrawal
The use of the portal does not exclude other legally permitted forms.
The consumer may also exercise the right of withdrawal by sending an unequivocal statement to soporte@elitextraining.es or using the form template included at the end of these Terms.
It will be sufficient for the communication to be sent before the end of the 14 calendar days period.
Product returns
The consumer must return the products within 14 calendar days following the date on which they communicate the withdrawal.
Instructions and, where applicable, the return label will be provided via the Outvio returns portal or by email.
The direct costs of return will be borne by the consumer, unless Elitex Training expressly indicates otherwise or the return is due to a defective or incorrect product or an error attributable to us.
The use of a label provided by Elitex Training may be deducted from the refund when the return cost legally corresponds to the consumer and said cost has been previously informed.
Product condition
The consumer will only be liable for the decrease in value caused by handling other than that necessary to verify the nature, characteristics and functioning of the product.
The absence or deterioration of the original packaging will not automatically eliminate the right of withdrawal, although it may be assessed whether it has caused a real depreciation.
Refund
The refund will be made within 14 calendar days following notification of withdrawal and through the same payment method used in the purchase, unless the consumer expressly accepts another method.
Elitex Training may withhold the refund until the products are received or until the consumer provides sufficient proof of shipment, whichever occurs first.
The refund will include the price of the products and the standard delivery charges initially paid. It will not include any additional costs incurred by choosing a more expensive delivery method than the standard option offered.
Submitting the withdrawal electronically does not imply that the refund must be processed automatically before receiving the products or proof of their return.
Exceptions
The right of withdrawal will not apply, among other legally established cases, to:

Products made to the consumer's specifications or clearly personalized.

Products that may deteriorate or expire quickly.

Sealed products that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

Any other scenario excluded by the applicable regulations.
10. Defective, damaged or incorrect products
If a product arrives damaged, is not in conformity, or does not match the order, the customer must report it within a reasonable time through the portal. https://elitextraining.outvio.com/ or by writing to soporte@elitextraining.es.
You must indicate the order number and provide, where possible, photographs and a description of the incident.
Photographs may be required to verify damages, defects or errors, but not as a requirement to exercise an ordinary withdrawal.
When the incident is attributable to Elitex Training, we will assume the necessary costs of collection, repair, replacement or refund in accordance with applicable legislation.
A late communication will not deprive the consumer of their rights as long as the claim is within the warranty period.
11. Legal guarantee of conformity
New products purchased by consumers are covered by the legal guarantee of conformity for three years from their delivery, in accordance with Spanish legislation.
In case of non-conformity, the consumer may request repair or replacement, unless one option is impossible or disproportionate.
Where legally appropriate, you may request a price reduction or termination of the contract.
The warranty does not cover damage resulting from accidents, impacts, use contrary to instructions, unauthorized modifications, inadequate maintenance or normal wear and tear, unless they originate from a lack of conformity existing at the time of delivery.
12. Coupons and promotions
Coupons and promotions will be subject to the conditions, dates and products indicated in each campaign.
Unless otherwise stated, they cannot be combined or exchanged for cash and only one coupon can be used per order.
Elitex Training may cancel a discount or order when there is a clear error or fraudulent, automated, abusive use or use contrary to the conditions of the promotion.
13. Acceptable Use of the Site
The user agrees to use the Site lawfully and will not introduce malicious code, interfere with its operation, access systems or data without authorization, impersonate others, make fraudulent purchases or infringe the rights of third parties.
We may suspend accounts, limit access, or cancel orders when there are reasonable grounds to suspect fraud, abuse, or noncompliance.
14. Intellectual and industrial property
The texts, designs, photographs, videos, logos, trademarks, trade names, software and other content of the Site belong to Elitex Training or are used with the authorization of their owners.
Its reproduction, transformation, distribution, public communication or exploitation without prior authorization is prohibited, except for uses permitted by law.
15. Responsibility
Elitex Training will fulfill its obligations in accordance with applicable law.
It will not be liable for delays or non-performance caused by force majeure or unforeseeable or unavoidable circumstances beyond its control for as long as such circumstances last.
It will also not be liable for damages caused by use contrary to the instructions, by incorrect information provided by the customer or by third-party services that are not under its control, except when it is legally liable for them.
Nothing in these Terms will exclude or limit liability for willful misconduct, gross negligence, personal injury, non-conformity or any liability or right that cannot be excluded by law.
16. Customer service and complaints
Inquiries and complaints can be sent to soporte@elitextraining.es.
Requests related to returns, exchanges, cancellations or defective products may also be submitted through:

To facilitate the process, the customer must provide their order number and describe the request.
Elitex Training will respond within the applicable legal timeframe and will endeavor to do so, in any case, within 30 days of receiving your request.
Consumers may turn to public consumer bodies or a competent alternative dispute resolution entity.
17.Privacy and cookies
The processing of personal data is regulated in the Site's Privacy Policy.
The data entered on the returns portal will be processed to manage the corresponding withdrawal, exchange, return, warranty or incident.
Outvio may process such data as a technology provider for Elitex Training, in accordance with data protection regulations and applicable agreements.
The use of cookies and similar technologies is described in the Cookie Policy.
18. Modification of the Conditions
Elitex Training may update these Terms due to legal, technical, operational, or commercial changes.
The changes will be published with their update date and will apply to orders placed after they come into effect.
The new conditions will not retroactively modify orders already placed, unless a mandatory rule provides otherwise.
19. Assignment and subcontracting
Elitex Training may subcontract services necessary to execute the contract, such as payments, storage, transport, customer service or returns management, while maintaining its legal responsibilities towards the consumer.
The contract will not be assigned in a way that reduces consumer protections.
The client may not assign their rights or obligations without prior consent, unless such assignment is permitted by law.
20. Partial nullity and no waiver
If a clause is declared null, illegal or unenforceable, it will be deemed not to have been included to the extent necessary and the remainder will continue to be in force.
Failure to exercise a right immediately will not constitute a waiver of that right.
21. Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish law, without prejudice to the mandatory protection that may apply to consumers residing in other countries.
Disputes with consumers will be submitted to the competent courts and tribunals in accordance with applicable regulations, including, where appropriate, the consumer's domicile.
In relations between businessmen or professionals, the parties submit to the courts and tribunals of Cadiz, unless a mandatory rule establishes another jurisdiction.
MODEL WITHDRAWAL FORM
This form should only be completed and sent if the consumer wishes to withdraw from the contract.
